Privacy Policy
This Privacy Policy explains how OTAY CONSTRUCTION MANAGEMENT LLC ("Vagabond AI," "we," "us," or "our") collects, uses, discloses, and protects information when you use the Vagabond AI mobile application and related services (the "App"). By using the App, you agree to this Policy.
If you do not agree, please do not use the App.
1. Who we are (Controller)
OTAY CONSTRUCTION MANAGEMENT LLC, located at 5700 Collins Ave APT 8G, Miami, Florida 33140-2308, United States, is the data controller responsible for your personal information. For any privacy question or request, contact us at oguz@ogizgroup.com.
2. Information we collect
2.1 Information you provide
- Account & sign-in. If you sign in with Apple or Google, we receive your name and email address from that provider, and a provider account identifier. If you continue as a guest, we create an anonymous account identifier and do not collect your name or email.
- Profile. Username, first name, last name, date of birth, and an optional profile photo that you choose to provide.
- Content you create. Photos you capture or upload, AI "discoveries" you save, notes, saved places, trip plans, the preferences you enter to generate a trip (such as travel dates, who you travel with, budget, pace, transport, dietary preferences, accessibility needs, and free-text "must-see"/"avoid" notes), and favorites.
- Communications. Feedback, support requests, and ratings you send us.
2.2 Information collected automatically
- Usage & analytics data (via Google Firebase Analytics): app events, screens viewed, features used, language, and in-app usage counters (e.g., the number of scans, audio plays, photos, and saved places used against free-tier limits).
- Diagnostics (via Google Crashlytics): crash reports, device model, operating system version, and app version.
- Identifiers. App instance identifiers and similar technical identifiers used by our infrastructure providers.
- Approximate or precise location. Only while you are using the App and only with your permission, to suggest landmarks and places near you. You can disable location access at any time in your device settings.
2.3 Purchases
When you purchase a subscription, the transaction is processed by Apple (App Store) or Google (Google Play). We and our subscription provider (Adapty) receive your subscription status and related transaction metadata. We do not receive or store your full payment card number.
2.4 Sensitive information
Some optional inputs (e.g., dietary preferences, accessibility needs) and precise location may be considered sensitive in some jurisdictions. We use such information solely to provide the feature you requested and do not use it to infer characteristics about you for unrelated purposes.
3. How we use information
We use information to:
- Provide, operate, and maintain the App and its features (landmark scanning, library, trip planning, saved places, audio narration);
- Personalize content, including AI-generated insights and nearby suggestions;
- Create and manage your account and authenticate you;
- Process subscriptions and enforce free-tier limits;
- Analyze usage, debug, and improve the App;
- Detect, prevent, and address fraud, abuse, security, and technical issues;
- Communicate with you about service-related matters; and
- Comply with legal obligations and enforce our Terms.
4. Artificial intelligence (AI) processing
Core features use generative AI models (Google Gemini) accessed through Firebase AI Logic:
- Landmark identification sends the photo you scan, together with a prompt, to the AI model.
- Trip planning sends the text inputs you provide (such as destination and preferences) to the AI model.
- Both features use Google Search grounding, which sends related queries to Google to improve factual accuracy and may return links to third-party sources.
This data is processed by Google to generate the requested output. We instruct the models only to fulfill your request. AI outputs may be inaccurate or incomplete; see our Terms of Service. For details on Google's handling of this data, see Google's and Firebase's terms and privacy documentation.
5. How we share information
We do not sell your personal information. We share information only as described below:
- Service providers / sub-processors, who process data on our behalf:
- Google LLC / Firebase — hosting, authentication, database (Firestore), file storage, analytics, crash reporting, cloud functions, AI (Gemini), Google Places, Google Search grounding, and Google Sign-In.
- Apple Inc. — Sign in with Apple and App Store subscription processing.
- Adapty — subscription management and analytics (receives your account identifier, first/last name, username, account type, and subscription data).
- Legal & safety. When required by law, legal process, or to protect rights, safety, and the integrity of the App.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
6. Storage and security
Your data is stored on Google/Firebase infrastructure. We use reasonable technical and organizational measures, including encryption in transit and access controls, to protect your information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
Some data is also stored locally on your device (e.g., app settings, language, and cached images) and remains until you delete the App.
7. Data retention
We retain your personal information for as long as your account is active or as needed to provide the App. When you delete your account from within the App, we delete your profile, content, and stored images, and remove your authentication record. Analytics and crash data are retained according to our providers' default retention periods. Saved place information is stored using a durable place identifier and refreshed periodically (approximately every 30 days). We may retain limited information where required for legal, accounting, or security purposes.
8. Your choices and rights
You can:
- Access and edit your profile in the App;
- Delete your account and data at any time from within the App (Settings → account deletion);
- Control permissions (camera, photos, microphone, location) in your device settings.
Depending on where you live, you may have additional rights:
8.1 EEA/UK (GDPR)
You have the right to access, rectify, erase, restrict, and port your data, to object to processing, and to withdraw consent at any time. Our legal bases are: performance of a contract (to provide the App), your consent (e.g., for location and optional features), our legitimate interests (to secure and improve the App), and compliance with legal obligations. You may lodge a complaint with your local supervisory authority.
8.2 California (CCPA/CPRA)
You have the right to know, access, delete, and correct your personal information, and to limit the use of sensitive personal information. We do not sell personal information and do not "share" it for cross-context behavioral advertising. You will not be discriminated against for exercising your rights.
8.3 Türkiye (KVKK)
Under Law No. 6698, you have the rights set out in Article 11, including to learn whether your data is processed, request information, request correction or deletion, and object to results arising from automated analysis. Our processing relies on your explicit consent and other lawful grounds under the KVKK.

9. International data transfers
We and our providers process data in the United States and other countries that may have data-protection laws different from yours. Where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for international transfers.
10. Children's privacy
The App is not intended for children under 13, and we do not knowingly collect personal information from children under 13. We collect date of birth in part to help enforce this. If you believe a child has provided us personal information, contact oguz@ogizgroup.com and we will delete it.
11. Device permissions
The App may request the following permissions, which you can manage in your device settings:
- Camera — to capture photos of places for identification;
- Photo Library — to choose photos to analyze and to save images you create;
- Microphone — when recording video of a place;
- Location (while using the App) — to suggest nearby landmarks and places.
12. Third-party services and links
The App relies on third-party services (including Google/Firebase, Apple, and Adapty) and may display links to third-party sources (e.g., from AI grounding). Their handling of your data is governed by their own privacy policies, and we are not responsible for their practices.
13. Changes to this Policy
We may update this Policy from time to time. We will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the App after changes become effective constitutes acceptance.
